Terms of Service

These Terms govern your use of Bestservix (“Bestservix”, “we”, “us”), a set of SEO and AI-search visibility tools. By creating an account or using the service you agree to these Terms. If you do not agree, do not use the service.

1. What Bestservix is

Bestservix provides software that analyzes public web pages and reports estimates and insights, such as on-page SEO checks, keyword ideas, search-position estimates, and an estimate of whether AI assistants mention or link a given site. Everything we output is an estimate for your own research. We do not promise any particular search ranking, traffic, AI citation, or business outcome, and rankings and AI answers are controlled by third parties, not by us.

2. Your account

You are responsible for your account, your login credentials, and everything done under your account. You must provide accurate information and keep it current. You must be old enough to form a binding contract in your country to use the service.

3. Acceptable use

You agree that you will:

  • only analyze websites and domains that you own or are authorized to analyze;
  • use the service lawfully and not to infringe anyone’s rights or privacy;
  • not resell, sublicense, or provide the service to third parties except as your own end use;
  • not attempt to overload, disrupt, reverse engineer, or gain unauthorized access to the service;
  • comply with the terms of any third-party service you connect through the service.

You are solely responsible for the domains, keywords, and content you submit, and for how you use the results.

4. Third-party services

The service relies on third parties, including search engines and AI providers, to produce its results. These providers may change, rate-limit, or become unavailable at any time, which can affect the output. We are not responsible for the availability, accuracy, or actions of those third parties.

5. Plans, billing, and Polar

Paid plans are sold and processed by Polar as our Merchant of Record. Polar handles payment, applicable taxes, and receipts. Paid plans renew automatically each period until you cancel. You can cancel at any time from your account or billing portal, and your paid access continues until the end of the current paid period. Prices may change; we will give notice before a change affects your next renewal.

6. Refunds

Refunds are described in our Refund Policy. In short: the free tier lets you evaluate the service before paying, and paid plans are non-refundable except where the law requires otherwise. You can cancel anytime and keep access until the end of the paid period.

7. No warranty

The service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that any data, estimate, or third-party source is accurate or complete. Third-party search engines and AI providers may change, rate-limit, or block access at any time, and that is outside our control.

8. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total liability for any claim relating to the service is limited to the amount you paid us for the service in the three months before the event giving rise to the claim, or fifty US dollars, whichever is greater.

9. Indemnity

You agree to indemnify and hold us harmless from any claim, loss, or expense arising out of your use of the service, the domains or content you submit, your breach of these Terms, or your violation of any law or third-party right.

10. Intellectual property and trademarks

The Bestservix software, brand, and content are ours or our licensors’. Other product and company names, including ChatGPT and OpenAI, Perplexity, Google, Ahrefs, SEMrush, and Profound, are trademarks of their respective owners and are used only for identification and comparison. Bestservix is independent and is not affiliated with, endorsed by, or sponsored by any of them. Any comparison we make reflects our understanding of publicly available information at the time of writing and may change.

11. Suspension and termination

We may suspend or terminate access if you violate these Terms, abuse the service, or create risk or legal exposure for us or others, and in that case fees already paid are not refundable. You may stop using the service and close your account at any time.

12. Changes

We may update the service and these Terms. If a change is material, we will take reasonable steps to notify you. Continued use after a change means you accept the updated Terms.

13. Severability and entire agreement

If any provision of these Terms is held invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary and the remaining provisions will stay in full force. Our failure to enforce any right is not a waiver of it. These Terms are the entire agreement between you and us about the service and supersede any prior agreements.

14. Governing law and disputes

These Terms are governed by the laws of Vietnam, without regard to conflict-of-law rules, except where mandatory consumer-protection law in your country of residence applies. Before filing anything, you agree to contact us so we can try to resolve the issue first. Any dispute not resolved that way will be brought exclusively in the competent courts of Vietnam, and you consent to their jurisdiction, except where mandatory law lets you sue in your home courts. To the extent permitted by law, any claim must be brought individually and not as part of a class or representative action.
